Ohio Secretary of State's application to stay a temporary
restraining order (TRO) directing the Secretary of State, to update
Ohio's Statewide Voter Registration Database to comply with section
303 of the Help America Vote Act (HAVA) is granted and the TRO
vacated where: 1) the question of whether HAVA is being properly
implemented is not addressed; but 2) respondents are not
sufficiently likely to prevail on the question whether Congress has
authorized the district court to enforce section 303 in an action
brought by a private litigant to justify the issuance of a TRO.
