In a diversity suit arising under the Tennessee Products Liability Act (TPLA), summary judgment for defendant-Honda is reversed where: 1) circuit case law clearly prohibited consideration of unsworn letters from various experts for Honda; and 2) plaintiff presented sufficient evidence to establish the existence of genuine issues of material fact regarding whether an airbag in her vehicle was defective and caused her injuries. In taxpayers' action seeking a redetermination of their income tax for a certain tax year and asking that a prior audit be reopened so that they could produce the necessary supporting evidence, a tax court's ruling that it lacked jurisdiction over the petition and declining to transfer the case is affirmed where: 1) petitioners did not challenge the tax court's jurisdictional ruling; and 2) the tax court correctly concluded that it lacked authority to transfer the case under 28 U.S.C. section 1631.
