In removal proceedings, petition for review of a denial of a motion for a continuance is granted where: 1) an IJ's decision whether to grant or deny a motion for a continuance based solely on DOJ "case-completion goals", with no regard for the circumstances of the case itself, is arbitrary and an abuse of discretion; and 2) a BIA decision providing an alternate basis for removal was impermissibly based on its own findings of fact.
