Beck v. City of Upland, No. 05-56901
In a suit brought under 42 U.S.C. section 1983 for various
constitutional violations and for various state law causes of action
against a city, its police department, and officers who engineered
plaintiff's arrest, summary judgment against plaintiff is reversed
where: 1) on the summary judgment record, plaintiff demonstrated
with regard to either of the asserted constitutional violations that
a prosecutor's actions were not an intervening cause shielding the
officers from liability; 2) officers lacked qualified immunity; and
3) officers could not avail themselves of the California statutory
immunity they asserted.

US v. Santana, No. 07-50190
A decision revoke defendant's supervised release and imposing a new
term of imprisonment and supervised release is affirmed over claims
that: 1) his right to prompt disposition of the petition to revoke
his supervised release was violated by the government's unjustified
delays in executing a warrant for his arrest and in bringing him
before a judge for his initial appearance; and 2) the procedure for
revocation of supervised release is unconstitutional in light of
Cunningham v. California.
