In an action claiming defendant-company caused an explosion that injured plaintiff and damaged plaintiff's home, summary judgment for defendant is affirmed where: 1) the district court did not abuse its discretion by imposing a sanction excluding plaintiff's expert witness' testimony for violating Rule 26(a)(2); 2) it did not abuse its discretion when it refused to consider facts proposed in plaintiff's Rule 56.1 response for failing to separate his proposed facts from the responses to defendant's proposed material facts; and 3) the company did not admit causation in its state court pleadings.
