Petition for review of an order of removal finding petitioner a
deportable aggravated felon based on a conviction for battery is
denied where: 1) the elements of domestic battery under Illinois law
establish that it is a crime of violence subjecting him; and 2) the
court lacked jurisdiction to review a claim that the BIA applied the
incorrect legal standard when it determined that he did not qualify
for protection under the Convention Against Torture.

In an action claiming retaliatory action by plaintiff's superiors
arising out of comments made about a cold case and official
complaints about his superior officers, judgment for plaintiff is
reversed and the case remanded with instructions to enter judgment
for defendants where plaintiff was speaking pursuant to his official
duties, not as a citizen, and therefore was not entitled to
protection by the First Amendment.
