Arendale v. City of Memphis, No. 07-5230
In a civil rights suit brought by a white police officer against the
city of Memphis, summary judgment for the city is affirmed where: 1)
the implied cause of action contained in 42 U.S.C. section 1981 does
not provide for municipal liability; 2) summary judgment was proper
on a section 1983 disparate treatment claim; 3) for purposes of a
hostile environment claim, no reasonable jury could find that
plaintiff was harassed because of his race; and 4) there was no
competent evidence of retaliation.

In a prosecution for being an illegal alien in possession of
firearms and possession of unlawful identification documents, denial
of defendant's motion to suppress evidence is reversed where,
contrary to the ruling below, an extended detention violated
defendant's Fourth Amendment rights.

Petition for review brought by a citizen of Yemen of a final order
of removal is granted where the BIA abused its discretion in denying
a motion to remand to an IJ for further consideration of his
eligibility for adjustment of status as a "child" and immediate
relative of an American citizen under the Child Status Protection
Act (CSPA) and 8 U.S.C. section 1255.

Petition for review of an order of removal based on Jamaican
petitioner's status as an alien convicted of an aggravated felony is
denied over meritless claims that the expedited removal procedure to
which he was subjected, pursuant to 8 U.S.C. section 1228(b),
violated both his due process and his equal protection rights.
