In case involving liability for the explosion and resulting constructive total loss of the container ship the M/V DG Harmony, district court's finding that defendant PPG, which manufactured and shipped approximately 160,000 kilograms of calcium hypochlorite, was solely responsible for the explosion and loss, is reversed in part as to holdings that PPG was strictly liable under section 4(6) of the Carriage of Goods by Sea Act, and that it was liable under a general negligence theory. In a declaratory relief action brought by plaintiff in the U.S. seeking a declaration that defendant could not prevail against plaintiff on a libel claim under federal or state law, and that an English default libel judgment was not enforeceable in the U.S., dismissal of defendant is affirmed based on the New York Court of Appeals' answer to a certified question that N.Y. C.P.L.R. section 302(a)(1) does not confer personal jurisdiction over defendant. Read more...
