In an action brought by a former employee of defendant-school
district alleging racial discrimination and retaliation under 42
U.S.C. sections 1981 and 1983, summary judgment for defendants is
affirmed in part, but reversed in part and remanded where: 1) the
district court erred in finding that plaintiff had not provided any
direct evidence of discrimination and by not analyzing her
termination and non-assignment of homebound instruction claims under
the proper approach; and 2) the district court also erred in certain
summary judgment rulings made under the McDonnell Douglas test for
various claims.

affirmed over challenges to the district court's denial of
acceptance of responsibility credit, the imposition of a special
assessment, and the application of U.S.S.G. section 5K2.1.

A sentence for conspiracy to distribute methamphetamine is affirmed
where, although the district court did not adequately explain its
reasons for imposing the sentence, the error was not reversible as
defendant did not meet his burden to show that it affected his
substantial rights.
