In a Title VII gender discrimination suit brought against
plaintiff's former employer, the VA and its secretary, summary
judgment for defendants is affirmed where: 1) with respect to the
hostile work environment and discrimination claims, plaintiff failed
to exhaust his administrative remedies; and 2) a retaliation claim
could not be considered due to the failure to exhaust administrative
remedies on the other claims.

Maymi v. Puerto Rico Ports Auth., No. 07-1157
In an action brought against the Puerto Rico Ports Authority and
various officials, alleging political discrimination and
retaliation, summary judgment for defendants is affirmed where: 1)
as plaintiff was a trust employee, she was freely subject to removal
from her position and, thus, had no claim for adverse employment or
violation of First Amendment rights to free speech; 2) for purposes
of a claim that she suffered retaliation after her reinstatement to
a career employment position, she failed to allege sufficient facts
to support her claim of political discrimination; and 3) due process
and conspiracy claims also failed.
