In an action brought by Ford and its cargo insurer against
defendant-ocean carrier for damages arising from the loss of cargo
during a transatlantic voyage, partial summary judgment for
defendant and third-party defendants is reversed where the district
court erroneously interpreted the bill of lading to apply Carriage
of Goods by Sea Act (COGSA) instead of the Hague-Visby Rules, and
additional briefing and fact-finding may be required before the
liability limitation may be appropriately applied.

error regarding: 1) denial of his motion to suppress drugs found
during his arrests; 2) denial of his motion to exclude two expert
witnesses at his trial; 3) denial of his motion for a mistrial based
on prosecutorial misconduct; and 4) three statements which allegedly
constituted prosecutorial misconduct.

decision holding that the Chief Immigration Judge was authorized to
preside over petitioner's removal proceeding is denied as the Chief
Immigration Judge clearly meets the statutory definition of
"immigration judge."
