In an action brought following plaintiff's prosecution, conviction,
re-prosecution, and eventual acquittal for the alleged molestation
of his adopted daughter, partial denial of defendants' motions for
summary judgment is affirmed over claims that the district court
erred in: 1) denying detective's motion for summary judgment on
procedural due process and conspiracy claims; and 2) denying former
wife's summary judgment motion on conspiracy, false arrest, and
malicious prosecution claims.

US v. Greene, No. 07-1479
A sentence imposed following defendant's guilty plea to possessing
with intent to distribute cocaine base is vacated where, in light of
Rita v. US, 127 S.Ct. 2456 (2007), the district court's application
of a presumption of a reasonableness to the applicable guidelines
range was a significant procedural error which was not harmless.

US v. Huff, No. 07-1500
A sentence for being a felon in possession of a firearm is vacated
and remanded where, in light of Rita v. US, 127 S.Ct. 2456 (2007),
the district court's application of a presumption of a
reasonableness to the applicable guidelines range was an abuse of
discretion, and the error was not harmless.
