"... The crux of any patent litigation boils down to the validity of
the patent. The legal dialogue will focus on the essential claims
documented in the patent. The defendant will try to prove that the
claims are not new or inventive but are "obvious". On the other side,
the folks bringing the lawsuit must prove that these are valid claims
and are therefore being infringed.
