Simcox v. Simcox, No. 07-3911
A decision ordering defendant-wife to return to Mexico with two of
the four children currently residing with her in Ohio pursuant to
the Hague Convention on Civil Aspects of International Child
Abduction and its implementing legislation is reversed in part and
remanded for a determination of what conditions, if any, would be
appropriate and effective to ensure the safety of the children upon
their return to Mexico, pending the outcome of custody proceedings.

Petition for review of a decision rejecting Albanian couple's claims
for asylum and related relief is denied where: 1) substantial
evidence supported an IJ's finding that petitioner's asylum
application was frivolous; 2) substantial evidence supported a
finding that he was not credible; 3) even if the IJ erred as to such
determinations, substantial evidence supported a
conclusion that petitioner was not entitled to asylum; and 4)
consequently, withholding and CAT claims failed as well.
