bills that will [1]remove the exemption terrestrial radio broadcasters
currently enjoy that allows them to broadcast music without compensating
the artists or labels for it. In the current dispensation only
songwriters get paid. The National Association of Broadcasters is furious
at the RIAA, which is pushing repeal of the exemptions, and has responded
by agreeing that artists need better compensation ?€? and is asking
Congress to [2]investigate modern recording contracts. "

A number of readers are sending in the news that the Mac rumors site
[0]Think Secret will be shutting down, as part of the (secret) settlement
of a lawsuit [1]Apple filed in 2005. Apple had claimed that the blog,
published since 1998 by college student Nick Ciarelli, had revealed
Apple's trade secrets. The only other detail of the settlement that has
been revealed is that Think Secret was not forced to reveal any sources.

number of products this community has discussed made the cut. The top
spot, the position of most dishonor, was almost a foregone conclusion.
"Another December, another list, another crowning achievement by the
Emperor of the Ethereal, the Head Honcho of Hype, Duke Nukem Forever. We
were going to disqualify him out of pity, but Sir Duke is back for 2007
thanks to a few leaked screenshots and an overwhelming number of votes.
DNF creators 3D Realms even chose this week to debut a well-publicized
video trailer for Duke's long-awaited return. Alas, a trailer is not a
game, so ?€? long live the king!"

[0]Bogie Lowenstein is one of many readers letting us know that the
[1]FTC has approved Google's acquisition of DoubleClick in a 4-to-1 vote.
The FTC essentially blew off the privacy concerns about the merger,
saying it lacked the legal authority to block the deal on any grounds
except antitrust. The EU's review of the deal is still going forward,
with a decision due by April 2, 2008; the [2]privacy sensibility there is
more sharply focused.

mlimber tips a story in New Scientist about a powerful cosmic explosion
that has astronomers scratching their heads. It apparently resulted from
a [0]supernova detonating in empty space, far from any galaxy.
Researchers propose that the exploding star was in the gas trail yanked
out of a galaxy when it passed or began merging with another. Quoting the
lead author of the study: "Even if the galaxies have stopped forming
stars, in the tidal tails you can trigger new episodes of star formation
[not to mention detonation]." The research will be published in the
Astrophysical Journal.

writeup on [0]JavaScript performance in the big four browsers. He used
[1]WebKit's newly announced SunSpider to produce the results. If a
probable anomaly in the IE7 results is overlooked, Firefox 2 is the
slowest of the bunch. Atwood has also [2]benchmarked the latest Firefox
Beta, and its performance seems to be improved significantly."

[0]coondoggie sends us to another Network World piece, this one about a
couple [1]charged with shining a green laser into the cockpit of a police
helicopter. The FBI and the US attorney's office charged the California
couple under a federal statute. They could end up paying a $250,000 fine
and doing 20 years of jail time. "The complaint states that on November
8, 2007, at about 10:55 p.m., a green laser beam illuminated the cockpit
of a Kern County Sheriff's Department helicopter, which was flying at 500
feet during routine patrol in Bakersfield, California. When the light hit
the cockpit, it disoriented the Kern County Sheriff's pilot, causing pain
and discomfort in his eyes for a couple of hours, the FBI said in a
statement."

thrilled to have reporters live blogging events in order to generate more
interest and keep passionate fans talking about NCAA sports. Not so. The
governing body of the NCAA has [0]released new rules for receiving press
credentials and it includes severe limits on live blogging. If you're
covering NCAA football, make sure you don't blog more than 3 times in a
single quarter. If it's baseball, one post an inning is all you get. If

patent portfolio tops the industry in terms of overall quality of its
patents. And while [2]Microsoft came in second to IBM in The Patent
Board's 2006 survey, its upcoming 2007 report has Microsoft besting IBM
(and even its 2006 report had Microsoft #1 in terms of the "scientific
strength" of its patent portfolio). All of which begs the question: Just
where is all this innovation going? To Clippy? Consumers and business
users don't buy patents. They buy products that make their lives easier
or more productive, yet Microsoft doesn't seem to be able to turn its
patent portfolio into [3]much more than life support for its existing
Office and Windows monopolies. In sum, if Microsoft is so innovative, why
can't we get something better than the Zune?"

the EU Commission complaints. With PFIF's objective to aid open source,

story of a Pennsylvania man who brought his computer into Circuit City to
have a DVD burner installed on his computer and wound up being arrested
[1]for having child pornography on his hard drive. Circuit City employees
discovered the child pornography while perusing Kenneth Sodomsky's hard
drive for files to test the burner, then proceeded to call the police,
who arrested Sodomsky and confiscated the computer. Sodomsky's lawyer
argued in court that the Circuit City techs had no right to go rifling
through the hard drive, and the trial court agreed, but prosecutors
appealed and the appeals court overturned the lower court's decision,
based on the fact that Sodomsky had consented to the installation of the
DVD drive."

Maryland scientists the green light to fly the [2]Deep Impact probe to
Comet Hartley 2. The spacecraft will pass Earth on New Year's Eve at the
beginning of a more than two-and-a-half-year journey to Hartley 2. During
the first six months of the journey to Hartley 2, they will use the
larger of the two telescopes on Deep Impact to search for Earth-sized
p***ts around five stars selected as likely candidates for such p***ts.
Upon arriving at the comet, Deep Impact will conduct an extended flyby of
Hartley 2 using all three of the spacecraft's instruments ?€? two
telescopes with digital color cameras and an infrared spectrometer."
