COURT DENIES FEES INCURRED DUE TO LATE FILING
The District Court of Oklahoma County was wrong to award a construction subcontractor attorney fees incurred due to a one-day delay in filing legal documents, the Oklahoma Court of Civil Appeals ruled last week. No statutory authority
exists for awarding attorney fees under such circumstances, the appeals court found. The trial court has an inherent authority to impose attorney fees as sanctions only in cases where there is a finding of bad faith or oppressive behavior,
ruled the appeals court.

CRIMINAL CHARGES FILED ON TABOR PETITION OFFICIALS
Criminal charges have been filed against TABOR signature-drive officials. Richard Carpenter, Paul Jacob and Susan Johnson are each accused of one count of conspiracy. Carpenter also faces one count of violation of Oklahoma's initiative
petition law.
EX-CREEK HOUSING HEAD CLAIMS MISMANAGEMENT OF $69M IN GRANT FUNDS
The former director of the Creek Nation Housing Authority has filed a whistleblower lawsuit alleging misuse of $69 million in federal housing grant funds. Robert Jack and other housing authority officials were terminated in April 2004,
when the Muscogee (Creek) Nation took over control of the agency, which had been operated by a board of commissioners.
GASSAWAY TRIBUNAL ASKS COURT FOR MORE TIME
The professional responsibility tribunal that heard allegations against Oklahoma City attorney Mike Gassaway asked Friday for a second extension of time in which to file its report with the Oklahoma Supreme Court. The panel was initially
required to file its recommendations in November, but requested an extension. In its latest filing, the tribunal has requested an extension to Dec. 27.
