Nascimento v. Dummer, No. 06-35062
In a suit asserting various claims against plaintiff's ex-wife and the attorney who had represented her in a prior custody dispute, alleging that improprieties took place in connection with the custody dispute, dismissal of the suit is affirmed where: 1) it was proper for the district court to begin exercising jurisdiction over the case, despite a pending appeal; 2) a district court acted within its sound discretion in denying plaintiff's motions for an extension of the discovery deadline; and 3) plaintiff's failure to comply with court orders was properly sanctionable by a dismissal of his case without prejudice.
