Pagan v. Fruchey, No. 04-4414
In an action against a town and police chief alleging that a section
of the town's traffic code constitutes an unconstitutional
restriction on commercial speech, specifically "For Sale" signs on
cars, summary judgment for defendants is reversed as defendants
failed to produce evidence that justifies the restrictions on
commercial speech imposed by the ordinance.

US v. Villareal, No. 05-6838
A sentence pursuant to a plea agreement to distribution and
possession with the intent to distribute cocaine and an order
denying defendant's motion to compel the government to file a motion
for a downward departure is remanded for further proceedings as it
was unclear whether the government exercised its discretion under
the plea agreement in deciding whether defendant provided
substantial assistance.
