[0]NewYorkCountryLawyer writes "The online community now has an
opportunity to see the fruits of its labor. Back in December, the
[1]Slashdot ('What Questions Would You Ask an RIAA Expert?') and
[2]Groklaw ('Another Lawyer Would Like to Pick Your Brain, Please')
communities were asked for their input on possible questions to pose to
the RIAA's 'expert'. Dr. Doug Jacobson of Iowa State University, was
scheduled to be deposed in February in [3]UMG v. Lindor, for the first
time in any RIAA case. Ms. Lindor's lawyers were flooded with about 1400
responses. The deposition of Dr. Jacobson [4]went forward on February 23,
2007, and the transcript is now [5]available online (pdf) ([6]ascii). Ray
Beckerman, one of Ms. Lindor's attorneys, had this comment: 'We are
deeply grateful to the community for reviewing our request, for giving us
thoughts and ideas, and for reviewing other readers' responses. Now I ask
the tech community to review this all-important transcript, and bear
witness to the shoddy investigation and junk science upon which the RIAA
has based its litigation war against the people. The computer scientists
among you will be astounded that the RIAA has been permitted to burden
our court system with cases based upon such arrant and careless
nonsense.'"

[0]MCraigW writes "[1]Simultaneous warming on Earth and Mars suggests
that our p***t's recent climate changes might have a natural ?€? and not a
human-induced ?€? cause. Mars, it appears, has also been experiencing
milder temperatures in recent years. In 2005 data from NASA's Mars Global
Surveyor and Odyssey missions revealed that the carbon dioxide 'ice caps'
near Mars's south pole had been diminishing for three summers in a row.
Habibullo Abdussamatov, head of the St. Petersburg's Pulkovo Astronomical
Observatory in Russia, says the Mars data is evidence that the current
global warming on Earth is being caused by changes in the sun."

stretch to imagine a person searching for a book, finding something else
and then buying both books."

FlatCatInASlatVat writes "Kurt Hanson's Radio Internet Newsletter has an
analysis of the new royalty rates for Internet Radio announced by the US
Copyright Office. The decision is likely to [0]put most internet radio
stations out of business by making the cost of broadcasting much higher
than revenues. From the article: 'The Copyright Royalty Board is
rejecting all of the arguments made by Webcasters and instead adopting
the "per play" rate proposal put forth by SoundExchange (a digital music
fee collection body created by the RIAA)...[The] math suggests that the
royalty rate decision ?€? for the performance alone, not even including
composers' royalties! ?€? is in the in the ballpark of 100% or more of
total revenues.'"

source close to the CSS Managed Recording forum said that technology
which allows [0]movies to be downloaded and burned to blank DVDs, using
the same content-protection system as commercial discs, received official
approval on Thursday. 'The technology will require discs that are

players ... Despite Thursday's approval, services that allow consumers to

[0]Manequintet writes "Joanna Rutkowska's latest bit of rootkit-related
research shatters the myth that hardware-based (PCI cards or FireWire
bus) RAM acquisition is the most reliable and secure way to do forensics.
At this year's Black Hat Federal conference, she [1]demonstrated three
different attacks against AMD64 based systems, showing how the image of
volatile memory (RAM) can be made different from the real contents of the
physical memory as seen by the CPU. The overall problem, Rutkowska
explained, is the design of the system that makes it impossible to
reliably read memory from computers. "Maybe we should rethink the design
of our computer systems so they they are somehow verifiable," she said."

An anonymous reader writes "The Washington post reports that the FDA is
expected to approve the marketing of the new antibiotic called Cefquinome
for use in cattle. This is over objections of the American medical
association, the FDA advisory board and the World Health Organization.
Cefquinome is from a class of highly potent 'last line of defense'
antibiotics for several serious human infections. It is feared that large
scale use in cattle [0]will allow bacteria to develop a resistance to
these drugs. This news follows complaints from the FDA that it is no
longer getting the funds needed to do the research required for the
desired level of food safety."

An anonymous reader writes "RDM asks [0]Can Apple Take Microsoft on the
Desktop?, a comparison of recent sales and profits and the future outlook
for Macs and PCs. It's the opinion of the article's author that Apple
doesn't have to take a majority share of the desktop market to win. The
key is to take the most valuable segments of the market. They show via a
few quick financial numbers that even though Apple is selling fewer
machines, they're making more money per machine than your Dells or your
Gateways. Not being beholden to Microsoft gives them a big advantage when
competing with traditional PC sellers. Once Apple is positioned,
Microsoft will be forced to choose whether it wants to battle Mac OS X
for control of the slick consumer desktop, or repurpose Windows as a
cheaper, mass market alternative to Linux in corporate sales. If it
doesn't make a choice, the company will face difficult battles on two
fronts.""
